How clubs can structure, document and manage player contracts with clear responsibilities.

For a club, a player contract involves more than a signature. Duties, appearances, remuneration, bonuses, additional rights and responsibilities should be arranged so that the board, sporting management and player work from the same agreement.
This page focuses on contract design and day-to-day management for clubs. Transfers, changes of club and termination are separate topics and are addressed only to draw a clear boundary.

Contract structure: what the club should regulate
Start by classifying the relationship. Depending on how cooperation is organised, a contract may contain employment-law elements. The heading alone is not decisive. The agreed service and actual integration into training, matches and instructions matter. Section 1151 of the Austrian General Civil Code links a service contract to agreed work in return for remuneration.
The club should cover the parties and authority, start date, duration, duties, training and matches, remuneration, bonuses, expenses, absences, illness and injury, confidentiality, data protection, image and marketing rights, and the process for amendments.
Duties of the club and player
Duties should be understandable in daily operations. They may include schedules, contact persons, medical procedures, equipment, media appearances, sponsor contacts and club rules. The club should record its own services and decision paths, not only player duties.
Internal regulations may supplement the contract, but do not replace clear terms on essential economic and personal duties. Identify the version, scope and accessible place where incorporated regulations can be found.
Remuneration, bonuses and expenses
A comprehensible remuneration structure prevents later disputes. Fixed amounts, appearance bonuses, performance bonuses, benefits and expenses should be described separately. Each variable item needs a trigger, calculation, period, due date and evidence.
Material promises should not remain only in chats or oral meetings. Use a dated amendment for changes. Tax and social-security treatment depends on the actual structure.
Club bodies, approvals and records
Risks often arise where board, sporting management and administration meet. The Austrian Associations Act and club statutes provide the organisational framework. Check who represents the club, which resolutions are required and who may approve amendments.
A concise contract file contains the signed contract, annexes, regulations, amendments, resolutions, accounting records and relevant approvals.
Common risk points in club operations
Unclear bonuses, conflicting annexes, missing authority, undocumented amendments and clauses that do not reflect actual operations are common risks. Mixing remuneration, expenses, sponsorship and image rights complicates accounting.
For injury, prolonged absence or changes in appearances, compare the contract, actual practice and any mandatory requirements before assuming a change.
Boundary to transfers and termination
This page addresses the agreement between club and player and its ongoing organisation. A transfer or change of club involves additional parties, approvals and sporting regulations. Termination or mutual release requires a separate review of the contract, deadlines and consequences.
The club should not rely on a general template alone in these situations.
Is every player contract automatically an employment contract?
No. The label alone is not decisive. The agreed services and actual performance matter, including integration, instructions and payment.
Should bonuses be regulated separately?
Yes. The trigger, calculation, period, due date and evidence should be clear for each material bonus.
Who may sign for the club?
This depends on the statutes, club organisation and any required resolution. Check and document authority before signing.
What is special about youth players?
Consider the minor, guardians, education, supervision, travel and image use. An adult template needs adjustment.
When is an amendment needed?
For changes to material economic or personal terms, especially remuneration, bonuses, duties, duration or rights.
